Enough ! Enough has been ranted for so called quick fix rape remedies ! death sentences, chemical castrations, not so chemical castrations and what have you ! I think We are a community of cause and effect ! we are constantly on the prowl of something untoward and pronto! There goes our intellectual diarrhea !
So the Delhi rape and its ‘ Delhi backlash’ that snowballed as a national anger avalanche ! Good ! nothing wrong as long as the cause is non political and people participate without any vestige interest.
While I wont go in the stage managed Delhi protests organized with political interests, ( it started from an innocent and genuine people participation though to be later hijacked by youngsters with …you guessed it.. political backgrounds ) , I’d certainly focus on the debate that has become the topic of the hour in our country post Damini tragedy ! ‘WHAT SHOULD WE DO TO CHECK THE SCOURGE OF RAPE AND WOMEN DEMEANING CRIMES IN THIS COUNTRY ’ ?
I am on the firm opinion that awarding death penalty is or the now national jargon initiated by television media ‘CHEMICAL CASTRATION’ will not, repeat not curb rape related crime ! Should that be the case, murders would not have been so rampant in our country which incidentally has one of the largest homicidal crimes in the world , considering the provisions of capital punishment in our rule books !
Lets check the statistics ! As an average , there are a whopping 265 rape related crimes in our country everyday. Ironically the numbers haven’t dwindled despite a nationwide protests post Damini tragedy to the best of my knowledge ! Rapes are still carrying on shamelessly including the national capital even after a colossal national blast !
I think laws can check crimes to a certain level ! like I said , ‘certain level ‘ ! Beyond it, its over to the societal handling and the Big ‘J’ , the judicial system that’s getting rot in the rule books written decades ago. The medieval judicial mechanism if I can say !
Most Offenders are more of clever lawyers themselves who have a clear idea about the loopholes and the turtle speed of justice deliverance in this country ! In My view , paradoxically the most sinister and dangerous anti social power in our country is ironically our own JUDICIARY ! Iam writing this with all responsibility of a citizen and tax payer of this land.
The jargons of chemical castrations and death penalty have a resounding effect only on media related programs. Its not going to hold enough water when it comes to curbing the offense. I was chatting with some officers in police today and we shared the though almost unanimously ! Indian media is trying to be sensational almost overnight and trying to cath up with their western counterparts without logically rationalizing the socio economic, social fabrick and literacy levels of their country. This sensationalism centric approach is not only daft but dangerous. dangerous because the television media is driven by TRP escalating stories! or else why did not a single channel did not take up the poor police constables death as seriously as they did with the main case ? why ? did he not deserve equal sensitive 'media investigation' ?
his only fault was he was a police personal who was discharging his duties from the orders that came from 'TOP' ? Or was he not 'sellable' enough ? I thing we too are becoming a voyeuristic society ! we love to see what we want to see good or bad !!
Proclaimed offenders specially of such dastardly crimes in my view should be made public immediately ( on the contrary the law gives them the privacy till the trial is on) , beaten black and blue, stripped naked in and televised in full public view and then sent to gallows but with full jurisprudence .
For every law there's an equal and opposite law misuse ( yes Newton’s Indian laws !!)
Take the 389 dowry act ! do you have an idea how many innocent men are blatantly arm twisted or thrown behind bars along with their old parents for no fault of theirs ? do you just have an idea ?
I have personally helped to such unfortunate victims, one just at the nick of the time ! his only mistake ? he raised his voice because his wife was seeing someone for months and he happened to catch them both red handed one late night as he returned from late hard work !
How then could you guarantee no such misuse of this draconian law will happen should the death penalty be made a law for rape related crime? We Indians are driven by emotions and reflexes. Unfortunately even the responsible law makers in the parliament too give up at the public outcry without deliberating on the long term repercussions of the law being enacted!
Imagine your neighbor getting hanged ..his only mistake, he couldn’t manage a year old live in relationship, imagine a courtship going sour and the guy going to gallows simply because the lady misused the draconian brahmastra to her favor.
No am not against harsh laws and amendments! In fact I’d been writing so much about their up gradations, the point am trying to raise here is pontification of gender related subjects without deliberating its far sighted pros and cons. Fast track courts are a welcome step. Take steps that deter such morons from within. Hang them too ! But one common law for word called rape without considering its veracity and context is fools kingdom !
